Accident ‘make up’ pay is an additional ‘sweetener’ to the state-based, legislated workers’ compensation schemes. The ‘make-up’ pay component represents the gap between the workers’ compensation payment paid by the employer’s workers’ compensation insurer, and the employee’s ‘pre-injury average weekly earnings’ (“PIAWE”).
